Trendllly is a social media analytics and trend discovery platform that helps content creators:

• Analyze their social media account performance and engagement metrics
• Discover trending topics and content ideas across multiple platforms
• Track viral content across social media platforms including YouTube, Instagram, and TikTok
• Generate AI-powered content suggestions, scripts, and predictions
• Optimize their content strategy based on data-driven insights
• Plan, schedule, and manage content across platforms
• Monitor competitors and industry trends

The Service is provided "as is" and may be updated, modified, or discontinued at any time.

To use certain features of the Service, you must create an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain the security of your account credentials and not share them with others
• Notify us immediately of any unauthorized access to your account
• Accept responsibility for all activities that occur under your account
• Ensure that you log out from your account at the end of each session

When you connect your social media accounts to our Service:

• You authorize us to access your profile information and public media through the respective platform APIs
• You must comply with each platform's Terms of Use and Community Guidelines
• We will only access data that you explicitly authorize
• We will NOT post content on your behalf or access your private messages
• You can revoke access at any time through the Service or the respective platform's settings

You agree NOT to:

• Use the Service for any illegal or unauthorized purpose
• Violate any applicable laws, regulations, or third-party rights
• Infringe on any third party's intellectual property rights
• Attempt to gain unauthorized access to our systems or other users' accounts
• Use the Service to spam, harass, threaten, or harm others
• Scrape, copy, or redistribute data from the Service without express permission
• Use automated tools, bots, or crawlers to access the Service without our consent
• Reverse engineer, decompile, or disassemble any part of the Service
• Resell, sublicense, or commercially exploit access to the Service without authorization
• Upload malicious code, viruses, or harmful content

Violation of these restrictions may result in immediate termination of your account and may subject you to legal liability.

You retain ownership of all content you create, upload, or input into the Service. By using the Service, you grant us a limited, non-exclusive, royalty-free license to:

• Use, display, and process your content solely for the purpose of providing the Service
• Store and backup your content to ensure Service reliability
• Analyze your content to provide AI-powered recommendations and insights

You represent and warrant that:

• You own or have the necessary rights to all content you provide
• Your content does not violate any third-party rights or applicable laws
• Your content does not contain defamatory, obscene, or harmful material

7.1 Our Content

The Service, including its design, features, code, branding, logos, and content (excluding user content), is owned by Trendllly and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works from our content without express permission.

7.2 Your Content

You retain all ownership rights to your content. We claim no ownership over any content you create or upload. Our license to your content is limited to what is necessary to provide the Service.

Some features of the Service may require a paid subscription. If you purchase a subscription:

• You agree to pay all applicable fees as described on our pricing page
• Subscriptions auto-renew unless cancelled before the renewal date
• You can cancel your subscription at any time through your account settings
• Cancellations take effect at the end of the current billing period
• We reserve the right to change pricing with 30 days' notice
• All fees are non-refundable except as expressly stated in our Refund Policy

• Free Tier: No refunds applicable as the Service is provided free of charge
• Paid Subscriptions: Refund requests must be made within 14 days of purchase
• Annual Plans: Pro-rated refunds available for unused portion if cancelled within 30 days
• Service Outages: If the Service is unavailable for more than 48 consecutive hours, affected subscribers may request a pro-rated credit
• Refund Processing: Approved refunds will be processed within 14 business days

To request a refund, contact us at billing@trendllly.com with your account details and reason for the refund request.

We may terminate or suspend your access to the Service:

• For violations of these Terms
• For illegal or fraudulent activity
• For prolonged inactivity (accounts inactive for 12+ months)
• At our sole discretion, with or without cause, with or without notice

You may terminate your account at any time through your account settings or by contacting us.

Upon termination:

• Your right to use the Service immediately ceases
• We may delete your account and associated data within 30 days
• Provisions that by their nature should survive termination will survive (including limitation of liability, indemnification, and governing law)
• Any outstanding fees remain payable

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• Merchantability or fitness for a particular purpose
• Accuracy, reliability, or completeness of any information or content
• Uninterrupted or error-free operation of the Service
• That the Service will meet your requirements or expectations
• That AI-generated content suggestions will result in viral or successful content

Analytics data, predictions, and recommendations are provided for informational purposes only and should not be relied upon as the sole basis for business or content decisions.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TRENDLLLY SHALL NOT BE LIABLE FOR ANY:

• Indirect, incidental, special, consequential, or punitive damages
• Loss of profits, data, use, goodwill, or other intangible losses
• Damages arising from your use of or inability to use the Service
• Damages arising from unauthorized access to your account or data
• Damages resulting from AI-generated content suggestions or predictions

Our total liability for any claim shall not exceed the amount you paid us in the 12 months preceding the claim, or $100 USD, whichever is greater.

You agree to indemnify and hold harmless Trendllly, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any third party rights, including intellectual property rights
• Your content or data provided through the Service
• Your violation of any applicable laws or regulations

Any disputes arising from or relating to these Terms or the Service shall be resolved as follows:

1. Informal Resolution: Parties shall first attempt to resolve the dispute through good-faith negotiations
2. Mediation: If informal resolution fails, parties agree to attempt mediation before pursuing other remedies
3. Arbitration: If mediation fails, disputes shall be resolved through binding arbitration in accordance with applicable arbitration rules
4. Court Proceedings: Either party may seek injunctive relief in court to protect intellectual property rights

These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be resolved in the courts of India.

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

We reserve the right to modify, suspend, or discontinue the Service (or any part thereof) at any time, with or without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuation of the Service.

We may also impose limits on certain features or restrict access to parts of the Service without liability or refund obligations.

The Service may contain links to third-party websites or services that are not owned or controlled by Trendllly. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party websites or services. You acknowledge and agree that Trendllly shall not be responsible or liable, directly or indirectly, for any damage or loss caused by or in connection with the use of any such content, goods, or services available on or through any such websites or services.
